Guardian Consent

This document explains how a parent or legal guardian gives, checks and withdraws consent for a young person's account on the OneLMS platform, including the clazz.lk marketplace and the teacher and institute school sites, operated by Panoralink Business Solutions (pvt) Ltd (PV 00286766). Sri Lankan data protection law treats a person under 16 as a child and requires a parent or guardian's consent. We also ask for a guardian's knowledge and permission for students aged 16 and 17.

1. Who Needs a Guardian

• Under 16: a parent or guardian must give consent before the account can be used. The guardian can do this in one of two ways. (a) The guardian owns and uses the mobile number used to sign in, and ticks the guardian declaration. (b) The guardian approves with a code or link sent by SMS to a different guardian mobile number. Until a guardian approves, the account stays locked.
• 16 or 17: you may accept for yourself. You must confirm that your parent or guardian knows about your use of the platform and agrees to it, including any payments. Your guardian can ask us at any time to withdraw consent or to delete the account.
• 18 or over: you accept for yourself.

2. How a Guardian Gives Consent for a Child Under 16

There are two ways. Either one is enough.

• Option A: you own the sign-in number. You are the person who owns and uses the mobile number the child signs in with. You tick the guardian declaration to say you are the child's parent or legal guardian and you consent.
• Option B: approval by SMS. The child gives a different mobile number for the guardian. We send a code or link by SMS to that number. You approve by entering the code or using the link.

The child's account is locked until a guardian approves. No one else can approve for you, including a teacher, an institute or our staff.

3. What You Are Agreeing To

By giving consent you agree that the child may use the platform. You accept the Student Terms for the child and you are responsible for the child's use and payments. You also consent to the collection and use of the child's personal data as described in our Privacy Policy. A child's data is special-category data, and we use it only for the child's learning, safety, payments and the other purposes in that policy.

4. Your Own Data

We keep your name and mobile number, and a record of your approval: the date and time, your IP address, the method you used and the account it applies to. We use them to confirm consent, to send approval and security codes, to send alerts you or the school have asked for, and to deal with your requests. We do not use your details for marketing unless you opt in separately. Panoralink Business Solutions (pvt) Ltd (PV 00286766) is the controller of this consent record. If a teacher or institute sends you attendance or fee alerts, it does so as the controller of its own class records, and you can ask it, or us, to stop.

5. Students Aged 16 and 17

A student aged 16 or 17 may accept for themselves. They must confirm that their guardian knows and agrees, including to payments. We may contact the guardian number if one is given. A guardian can ask us at any time to withdraw consent or to delete the account. When a child turns 16, we may ask them to accept the terms in their own name.

6. Withdrawing Consent

A guardian can withdraw consent at any time. It should be as easy as giving it.

• Use the withdrawal option in the approval message we sent you, or write to us at support@onelms.lk or phone 011 715 7712.
• We will check it is you by sending a code to the guardian mobile number we have on record.

When you withdraw, the account is locked straight away. We tell the teachers and institutes the child studies with, so that they stop using the child's data. We then delete or anonymise the child's data, except records the law requires us to keep, such as financial records, and the record of consent itself. Any unused balance is handled under our Refund & Cancellation Policy. Withdrawal does not undo what was done before you withdrew.

7. Your Rights for the Child

A guardian can ask to see the child's data, correct it, delete it, object to a use of it, or withdraw consent. We answer within one month. If we refuse, we will say why, and you can complain to the Data Protection Authority of Sri Lanka. See the rights section of the Privacy Policy.

8. Accounts Created by a Teacher or Administrator

If a teacher, institute or administrator creates an account for a student, they cannot accept these documents for the student. The student, or the guardian for a child under 16, must accept when first signing in, before the account can be used.

9. Record of Acceptance

When you accept, we record which document and version you accepted, the date and time, your IP address and the device or app you used. We keep this record as proof of what you agreed to. If we change a document in a material way, we may ask you to accept the new version before you continue. Earlier acceptances are kept.

Governing Law & Regulatory Framework

This document is intended to comply with the laws of the Democratic Socialist Republic of Sri Lanka, including, where relevant, the Personal Data Protection Act No. 9 of 2022 and the Electronic Transactions Act No. 19 of 2006.

These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. The parties will first attempt in good faith to resolve any dispute by negotiation; failing that, the courts of Colombo have exclusive jurisdiction, save that any dispute may instead, by agreement of the parties, be referred to arbitration under the Arbitration Act No. 11 of 1995, seated in Colombo and conducted in English. Nothing in this clause limits any right or remedy a consumer has under the Consumer Affairs Authority Act No. 9 of 2003.
